N.Y. judge rejects Google book deal

21310675021_googlelibrary.jpgSaying Google Inc. had overstretched, a federal judge on Tuesday rejected a deal between the giant search engine and lawyers for authors and publishers that would have let the company make money presiding over the world’s largest digital library.
U.S. Circuit Judge Denny Chin in Manhattan said the creation of a universal library would benefit many but would “simply go too far.” He rejected a $125 million settlement that was opposed by Google rivals, consumer watchdogs, academic experts, literary agents and even foreign governments.
Google has already scanned more than 15 million books for the project.
Chin said the settlement that the company reached with U.S. authors and publishers would “grant Google significant rights to exploit entire books, without permission of the copyright owners.”
The deal gives Google “a significant advantage over competitors, rewarding it for engaging in wholesale copying of copyrighted works without permission, while releasing claims well beyond those presented in the case,” Chin said. He said many of the concerns raised in objections to the settlement would go away if it were converted to an “opt-in” settlement from an “opt-out” settlement.
Hilary Ware, Google’s managing counsel, called the decision disappointing and said the company was considering its options.
The case developed after Google in 2004 announced it had agreed with several major research libraries to digitally copy books and other writings in their collections. The authors and publishers sought financial damages and a court order to block the copying when they sued Google in 2005 after Google failed to obtain copyright permission to scan the books.

    Its a great start. Over time you yourself will see the need for change and improvements further, you will feel what’s needed and what’s not bringing you the kind of results you’re looking for.

    On the home page, you have two images that changes, they appear to be an open Bible and a bookcase of books. I suggest you add children(s) books there (scattered on the floor), as one of the image that changes and perhaps another type of book, so all together you have at least 4 images changing.

        Well as a pdrouct owner… i would personally never offer a “lifetime” on anything except training. If it is a PDF… maybe but even that I think is unfair to the pdrouct owner… but with using software there are hard costs and support and all that and if after 90 days (not sure what the refund policy they have is going to be) you have not used it… then refund. If it is not working for you and you can see you are making money… then refund. I dont think it fair to any business that they should have to provide support for a lifetime and then a year later the person just decides to refund. AffiliateX had a great comment above… it comes down to you deciding if you are going to implement and use. If you are then in my opinion 90 days is more then enough to know if you need a refund or not. But this of course is just my opinion as both a consumer and pdrouct owner.

      How much did he spend to make such money. Not only the PPC costs – but also his oarheevd etc. Usually these great checks actually need even more money to create.He said on his video that the PPC costs were ~$2000 to make ~$2200. But how much did it cost to make the site, the other advertising, etc. And the risk for a newbie is quite large… how many failed PPC campaigns were going on at the same time that did NOT make money.Sorry to rain on the parade .. but people get burned with this stuff! It can work — with split testing etc. But, well, internet business is a BUSINESS. There are real risks. And it takes real work. It isn’t a get rich with no work thing.

      John…The omputim balance between a well written article/post (with the human reader in mind) and the carefully researched SEO worthy keyphrases relative to the topic is almost like an art… hence the difficult time many people have in writing non-boring content.However, I have a suggestion, if I may… not necessarily for your personal benefit as much as in fact intended for your readers.Mix your content wisely. Over the years of webdesign and best practices it was drilled into me (and likely professional web designers at the time) that the upper left hand side was best suited for navigation. Of course I was never concerned with monetizing the site.I believe this mindset.. along with years of common practice has influenced and set expectations of the web browsing public to expect navigation (which acts as a visual index of expected content), on the left hand side. So the eye is automatically drawn in this direction, and the compulsive ‘clicker’ will follow links out of habit as they scour for info. Next comes bold actionable forms/graphics mid-screen among the content which draws the eye.My biggest pet peeve, this may be just me, is having to scroll to the bottom of a page to access the actionable item. I have no need to see 100′s of testimonials.. nor a three page explanation of why I ‘need’ the widget whether is is free or otherwise.I have heard some say that your audience should be treated as if they are in Grade 4.. is there truth to this? Maybe I give everyone far too much intellectual credit.. Thanks again..
